The Analysis of Violations Included in Commissions (Article 100) of Municipality Act based on Comparative Results in Iranian Mega Cities

Abstract

The urban construction' violation of regulations and standards of quality, technical and urban planning in Iranian cities is rooted fact, that's rising progressively in line with growing of urbanization and increasing effective demand in the construction industry. This Illegality of building in metropolises with space restrictions, have more objectivity for long time. In Tehran, according to statistics provided by the administration of hundred commission of Municipality Act, by average of 100 new units, 15 units were excited with violation in 1390. Also in Mashhad metropolis for 31070 building permit issued since 1385 to 1391, most of its 7265 infringement was the case of building density. Furthermore in Esfahan metropolis, in 1391, 11036 cases of infringement have been brought in commissions (article 100) of Municipality. According to available statistics concerning infringements was referred to commissions (article 100) of Municipality in whole of country, Shiraz and Qom have minimum and Mashhad has maximum earning from receipt of the commission on construction infringement in one year. The aim of this paper is to find solution for the management of infringement of urban construction before applying coercive methods and in the form of knowing the causes and the consequences of it, according to the data finding of the metropolises of Iran in recent years. Synthesis method (survey and documentary) is selected for research. After the comparative statistical analysis of quantitative data, results will be interpreted by method in which the awards ofexperts of Municipality and Housing & Urbanizatio Organizatio ar analyzed. The findings of this study show that the executive factors an obstacles of urbanization' regulations which are effective in building infractions are following:
Incompatibility of regulations with the realities of society
Weaknesses of monitoring and controlling system
Lack of laws and regulations transparency
